Terms and Conditions

These Terms and Conditions ("Terms") apply to your use of www.gmdirect.com.au (the "Site") and to any order you place with GMD Activewear Australia Pty Ltd ("GMD Activewear", "we", "us" or "our"). By using the Site or placing an order with us, you agree to these Terms. Please read them carefully, and don't hesitate to contact us if anything isn't clear.

About GMD Activewear

GMD Activewear Australia Pty Ltd is an Australian, family-owned business based in Capalaba, Queensland, supplying gymnastics and aerobics apparel, teamwear and accessories to customers, clubs and teams across Australia and New Zealand.

Website Content & Intellectual Property

All content on this Site, including text, graphics, logos, images, product designs and code, is owned by or licensed to GMD Activewear Australia Pty Ltd and is protected under Australian copyright and trademark law. You may view, download and print pages from the Site for your own personal, non-commercial use, or for the purpose of placing an order with us. You may not reproduce, distribute, modify or otherwise use our content for any commercial purpose without our prior written permission.

Products, Pricing & Availability

We do our best to ensure that product descriptions, images and prices on the Site are accurate and up to date, but errors can occasionally occur. All prices are listed in Australian dollars (AUD) and include GST where applicable, unless stated otherwise.

If a product is mistakenly listed at an incorrect price or with incorrect information, we reserve the right to cancel the order, refuse the sale, or contact you to confirm whether you'd still like to proceed at the correct price, before the order is processed. If payment has already been taken for an order we cancel under this clause, we'll refund you in full.

Products are subject to availability. If an item you've ordered is out of stock or discontinued, we'll contact you to arrange a refund, exchange or substitute.

Orders & Payment

When you place an order, you're making an offer to purchase which we may accept or decline. We accept payment via the methods shown at checkout, including major credit and debit cards, PayPal and Afterpay (see our Afterpay page for details). Full payment is required before an order is dispatched, unless otherwise agreed in writing (for example, under a club or team payment plan).

Please check your order carefully before submitting it, including sizes, colours, personalisation and spelling. Once an order has entered production or been dispatched, we may not be able to make changes.

Shipping & Delivery

Shipping costs, timeframes and processing times are set out on our Shipping page. Delivery times are estimates only and are not guaranteed. GMD Activewear is not responsible for delays caused by the courier or postal service once an order has left our warehouse.

Returns, Refunds & Your Consumer Rights

Our returns and exchanges process is set out in full on our Return & Refund Policy. Nothing in these Terms or our Returns Policy excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law, which cannot be excluded. Where a product has a fault covered by the Australian Consumer Law, you're entitled to a repair, replacement or refund, and compensation for any other reasonably foreseeable loss or damage.

Custom, Made-to-Order & Club/Team Orders

Custom leotards, personalised items and club or team uniforms are made to order specifically for you or your club, generally after a deposit or full payment has been received and an ordering period has closed. Because these items are produced specifically to your order, they can't be cancelled, changed or returned once production has begun, except where required under the Australian Consumer Law (for example, if there is a manufacturing fault). Please check all sizing, colours, personalisation and spelling carefully before your order closes, as changes may not be possible once it does.

Club Uniform Webstores

Where GMD Activewear operates an online uniform store on behalf of a club or team:

Orders: orders may be placed online or via email. Please contact us if you have any issues with your order, we're always happy to help.

Pricing: we aim to keep pricing stable, but may need to adjust prices without notice if our supplier costs, freight or duty rates increase.

Payment: payment can be made via the secure payment methods offered at checkout. All orders must be paid in full before items are dispatched, and items remain the property of GMD Activewear until paid in full.

Exchanges & refunds: our standard Return & Refund Policy applies.

Ending a club webstore: if your club or team no longer wants to use GMD Activewear's webstore service, please let us know in writing at least 3 months before you'd like it to end. Any stock already held for your club must be paid for in full by the end of that 3 month period.

Limitation of Liability

To the extent permitted by law, GMD Activewear's liability for any loss or damage arising from your use of the Site or your purchase of our products is limited to the amount you paid for the relevant product, except where that loss or damage results from a failure to meet a consumer guarantee under the Australian Consumer Law, which cannot be limited or excluded. We are not liable for any indirect or consequential loss, except as required by law.

Use of the Website

You agree not to use the Site in any way that is unlawful, fraudulent, harassing, abusive or that infringes the rights of others. You must not attempt to interfere with the security or proper functioning of the Site, or upload or transmit any harmful code.

Third-Party Links

The Site may contain links to third-party websites (for example, Afterpay or Australia Post) for your convenience. We don't control these sites and aren't responsible for their content, privacy practices or availability. Please review the terms and privacy policy of any third-party site you visit.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our business or the law. The current version will always be available on this page, and changes will apply from the date they're posted.

Governing Law

These Terms are governed by the laws of Queensland, Australia. You agree that any dispute arising from these Terms or your use of the Site will be subject to the non-exclusive jurisdiction of the courts of Queensland, Australia.
